The well-known authors of the successful casebook Comprehensive Criminal Procedure present Criminal Procedure: Adjudication, which they have designed... for the criminal procedure course focused on trial and post-trial. Andrew Leipold, one of the nation's leading criminal procedure scholars, joins the author team, contributing to the wide range of backgrounds and expertise that accounts for the intellectual depth and sophistication of their books. Features of this contemporary casebook include: Thematic approach to the adjudication, highlighting: the key institutional relationships (and occasional conflicts) between courts, legislatures, prosecutors, and juries that affect the handling of cases within the criminal justice system, as seen most notably in such areas as charging decisions, plea bargaining, and sentencing law and policy; and the latent (but perhaps inherent) tension between lay participation in criminal cases (i.e., the jury) and the core criminal justice values of accurate and unbiased adjudication. Recent and important developments in the areas of ineffective assistance and self-representation. Discussion of the Supreme Court's recent line of Miranda decisions, as well as the recent dismantling of Michigan v. Jackson doctrine regarding the Sixth Amendment right to counsel. Discussion of pretrial screening and the grand jury. In-depth coverage of the scope of the prosecution, including venue, as well as speedy trial, joinder, and severance. Up-to-the-minute treatment of the Crawford doctrine, covering the scope and meaning of the defendant's Sixth Amendment right to confront the witnesses against him. Completely new and comprehensive coverage of the Apprendi-Blakely-Booker doctrine, reflecting both the legal and the practical consequences of applying the Sixth Amendment right to jury trial to sentencing factors.

This publication covers the law governing the criminal process, excluding sentencing. The first half of the book examines legal strictures on... investigative techniques--search and seizure, interrogation, subpoenas, identification procedures and underocover work--and the second half discusses the adjudicatory process, from pretrial detention and the charging decision through preliminary hearings, discovery, plea bargaining, trial, appeal and habeas, as well as double jeopardy doctrine, right to counsel issues, and state constitutional law. This book is popular among students, academics and lawyers for its concise and well-organized statements of the law, its trenchant analysis, and its attention to facts as well as legal doctrine. Each chapter ends with a summary of the law and a bibliography.

Changing Politics in Japan is a fresh and insightful account of the profound changes that have shaken up the Japanese political system and transformed... it almost beyond recognition in the last couple of decades. Ikuo Kabashima--a former professor who is now Governor of Kumamoto Prefecture--and Gill Steel outline the basic features of politics in postwar Japan in an accessible and engaging manner. They focus on the dynamic relationship between voters and elected or nonelected officials and describe the shifts that have occurred in how voters respond to or control political elites and how officials both respond to, and attempt to influence, voters. The authors return time and again to the theme of changes in representation and accountability.Kabashima and Steel set out to demolish the still prevalent myth that Japanese politics are a stagnant set of entrenched systems and interests that are fundamentally undemocratic. In its place, they reveal a lively and dynamic democracy, in which politicians and parties are increasingly listening to and responding to citizens' needs and interests and the media and other actors play a substantial role in keeping democratic accountability alive and healthy. Kabashima and Steel describe how all the political parties in Japan have adapted the ways in which they attempt to organize and channel votes and argue that contrary to many journalistic stereotypes the government is increasingly acting in 'the interests of citizens'--the median voter's preferences.

This title is the work of nationally renowned experts on the subject of constitutional criminal procedure. It is ideally suited for a survey course... designed to explore and critically examine how the U.S. Supreme Court has dealt with a wide range of highly controversial issues that arise at various stages of the criminal process. Considerable effort has been made to set forth the views of all members of the Court in landmark and important recent cases. The modest size of this volume has been attained not by collecting snippets of many opinions, but by the judicious selection of leading cases. An outstanding feature is the illuminating introductory commentary that appears throughout the book and place the selected cases in general historical and doctrinal perspective. In the 2012 edition, there is a new table added on the composition of the Supreme Court since 1940.

This book is designed for a complete Criminal Procedure course. This book is not designed exclusively for future criminal law practitioners. Rather, it... is designed as a roadmap for those who wish to learn about governmental limitations on police and / or trial procedures in the criminal context. The presentation of the materials is focused, rather than scattergun. Each case is presented, lightly edited, with a series of focused questions and notes following it.The importance of the questions cannot be overemphasized. Each student coming into class will (or should) have thought about the questions while reading the case. This should immensely improve the quality of class discussion. At the same time, the fact that the students have the questions in advance has a wonderful palliative effect on students, putting them at ease because they know the questions in advance. Additionally, the book is carefully edited with an eye towards the number of hours typically available for a class. The police practices material is designed to be taught in a three-hour class. The entire book is designed for a four-hour class.
