In this provocative book, the authors outline the crimes committed by the state under the protective shield of national security including the shaping... of foreign policy around the threat of nuclear hostility, the subjection of Americans to human radiation experiments, and the massive environmental contamination caused by radioactive waste. This insightful work clearly shows that the threats posed by nuclear states extend far beyond the dangers of nuclear war. The authors argue convincingly that criminologists, government officials, and the general public have for too long avoided and neglected the illegal aspects of nuclear weapons policies in particular, and the larger issue of state crime in general.

In compelling narrative, the authors probe the sensational cases of Nathan F. Leopold, Jr., and Richard A. Loeb, the Scottsboro "boys," Bruno Richard... Hauptmann, Alger Hiss, and O.J. Simpson, highlighting significant lessons about criminal behavior and the administration of criminal justice. Each case study details the crime, the police investigation, and the court proceedings, profiles the major players, and examines the outcome and aftermath of the trial. The authors untangle the perplexities surrounding the cases and illuminate the many mysteries that remain unsolved today. These celebrated trials reveal issues of overzealous prosecution, sloppy police work, judicial bias, race, class, and ethnic struggles, and the role of wealth in securing a competent defense. They also show how the temper of the times and frenzied media coverage heightened the intensity of drama in the cases.

Crimes of the powerful - the crimes committed by state institutions and private business organizations or corporations – are often overlooked by... Criminology, or are treated at best as a mildly interesting diversion from the real business of crime and criminal justice. Indeed, academic Criminology in the main tends to reinforce the idea that the real problems of society can be located in the lower strata of society and is yet to come to terms with overwhelming evidence that crimes of the institutionally powerful kill, rip off and steal from more people than crimes committed by individuals. This exciting Reader introduces debates on crimes of the powerful with a selection of 45 extracts from key authors. Each section of the book is introduced with an original essay to contextualize the readings and explain their importance for rethinking the relationship between crime and power. The book is organised into the following sections: State, Violence and Crime Partners in Crime Capitalism and Crimes of the Powerful Law and the Corporation Explanations Definitions The Problem of Criminalization If we are to fully understand the crimes of the powerful, it is crucial to recognise that the process of criminalisation is profoundly influenced by state institutions and corporations – and more importantly, by the relationship between them. The readings in this book show how their ability to both make and break the law remains a key source of power for those institutions. Crimes of the Powerful explores how law and 'crime' provide a framework for configuring and reproducing social relations of power, in doing so, provides criminology, sociology, politics and international relations students with new insights into a subject of growing importance.

Crimes of War—Iraq provides a comprehensive legal, historical, and psychological exploration of the war in Iraq from the same editorial team whose... 1971 Crimes of War was a landmark book about Vietnam and the revelation of American war crimes. The editors apply standards of international criminal law, as set forth at Nuremberg after World War II, and by subsequent developments regarding individual responsibility and accountability. These principles have to do with the waging of aggressive war, attacks on civilian centers of population, rights of resistance against an illegal occupation, and the abuse of prisoners. Explorations of psychology and human behavior include levels of motivation and response in connection with torture at Abu Ghraib; the phenomenon of the atrocity-producing situation in both Vietnam and Iraq (in which counter-insurgency, military policies, and angry grief could cause ordinary people to participate in atrocities); the behavior of doctors and medics in colluding in torture at Abu Ghraib; emerging testimony of American veterans of Iraq concerning the confusions of the mission, and the widespread killing of civilians; and accounts of broadening unease and psychological disturbance among men and women engaged in combat.

Prior to the emergence of a victims' movement in this country in the 1970s, crime victims had only limited formal rights and remedies in the modern... American justice system. With the active encouragement of those involved in the victims' movement and guidance supplied by a national Task Force on Victims of Crime, convened by President Reagan in 1982, federal and state authorization of crime victim rights and remedies has increased exponentially in recent years. In fact, it has been estimated that there are currently tens of thousands of statutes which directly or indirectly affect crime victim rights and interests, as well as victim-related constitutional provisions in a majority of states. The authors describe the constitutional and legislative provisions addressing the principal crime victim rights and remedies and leading judicial opinions that have interpreted them. In addition to presenting the current state of law in this area, the text describes the status of implementation of these rights and remedies, relevant empirical research, and a sampling of the pertinent policy analysis. This comprehensive portrait of the past and current status of crime victims rights and remedies in this country will inform the continued evolution of law and practice in this area. The second edition of Crime Victim Rights and Remedies will continue to address the evolution of key crime victim rights (e.g., the rights to notice of and to be present and heard at criminal justice proceedings) and will include the state constitutional amendments, legislation, court decisions, and empirical studies completed since the first edition in 2001. Of particular note will be an expanded federal section regarding each right and remedy reflecting the Crime Victims' Rights Act, enacted in 2004, and court decisions that have interpreted it thus far.
